Minnesota Department of Revenue (DOR) announces sales tax enforcement date for remote sellers and marketplace providers

On June 21, the United States Supreme Court announced its decision in the South Dakota v. Wayfair case and overturned the physical presence standard for sales/use tax nexus established in the 1992 Quill v. North Dakota case. Wayfair challenged a South Dakota law requiring sales tax collection for remote sellers and marketplace providers.

In 2017, Minnesota passed marketplace provider legislation that was scheduled to go into effect in 2019, or as soon as Congress or the Supreme Court under federal law allowed state sales tax collection by remote sellers. The Wayfair decision triggered Minnesota's law and resulted in this week's guidance from the DOR.

Minnesota will require remote sellers and marketplace providers facilitating sales into Minnesota to collect sales tax no later than Oct. 1, 2018.

Primary election coming to a location near you

There are about two weeks until the Aug. 14 primary election. Elections are an opportunity for all CPAs to express their views by voting for a candidate who most closely aligns with your views and to shape the public policy debate.

The 2018 election is somewhat unique because three of four constitutional offices do not have an incumbent running for re-election. You have an opportunity to vote for your state representative in the Minnesota House of Representatives and for your member of Congress in the United States House of Representatives. Both United States Senate seats are also on the ballot because of former Sen. Al Franken's resignation earlier this year.
