Before COVID-19, state tax nexus rules were already shifting. With the Supreme Court’s decision in Wayfair, the landscape surrounding sales and use tax nexus standards -- and potentially income and franchise tax standards -- was dramatically changed. What thresholds applied to whom, and to what specific types of sales, was in constant flux. Also under scrutiny: Whether economic nexus standards applied to income and franchise tax activities that may have traditionally been protected by Public Law 86-272. Then, most of us were told to work from home and federal legislation dramatically reduced already strained state tax revenue sources. Explore how we got to this current state and learn about the challenges taxpayers face when evaluating whether they have state tax nexus.
