Regular tax tune-ups ensure you’ll keep moving forward smoothly. Stay in the know with this monthly tax update series, featuring Ed Zollars, CPA.

About this month's webinar:
As a CPA, you have a responsibility to ensure that your clients' or employer's claims for the employee retention credit (ERC) are valid and supported by proper documentation. You may encounter situations in which you’re coerced to make an overly aggressive claim -- which puts your reputation and your practice at risk.

Examine the requirements for qualifying for the ERC in 2020 and 2021 and the documentation the IRS requires to justify the claim. Walk through a checklist of due diligence steps you should take to review any ERC claim before submission. Come away with insights to protect your client, your practice and your reputation in dealing with ERC claims.

Major subjects

  • Requirements to qualify for claiming the ERC in 2020 and 2021 -- e.g., significant decline in gross receipts or a full or partial suspension of business operations
  • Qualifying governmental orders vs. non-qualifying orders/recommendations
  • Ensuring proper coordination of the ERC claim with Paycheck Protection Program (PPP) loan forgiveness
  • Risks to employers and CPAs when an improper claim is filed -- IRS penalties and interest, misstatement of financial statements presented to lenders, civil liability, etc.
  • What to do when you suspect an employer has received an ERC that they don't qualify for -- communication tips, refund repayments and mitigating penalties and risks

Learning objective(s)

  • Understand the latest federal tax developments
